Andy Dogali, who has completed the Florida Supreme Court Mediation Certification Training Program, acts as mediator in connection with construction claims, insurance coverage disputes, and substantial commercial litigation matters.
Typically, in advance of an initial mediation session with Mr. Dogali, the parties will provide summaries, statements and/or documents for the mediator’s review. The parties will then meet in a joint session, during which each party will be given an opportunity to discuss or present their claim and their perspective, if they wish to do so.
Again, typically – because no two mediations are identical – Mr. Dogali will meet individually with the parties to gain a further understanding of how they each see the risks, costs and benefits of their claims and defenses. Mr. Dogali will not adjudicate the claim, as this is not the mediator’s role. Rather, he will attempt to the fullest extent he can to moderate and deliver communications, with the ultimate goal of helping the parties to forego the unpredictability and cost of litigation or arbitration, and to amicably resolve their differences.
